These Terms and Conditions form the legal agreement between The Helix Alliance Limited, trading as MotoGuardian ("the Company"), and every Customer who purchases, registers or uses MotoGuardian products or services. They should be read together with our Privacy Policy, Warranty Policy, Returns & Refund Policy, and Subscription Terms.
By purchasing a MotoGuardian Device, creating an account, downloading or using the MotoGuardian mobile application, or otherwise accessing MotoGuardian products or services, you acknowledge that you have read, understood and agree to be bound by these Terms.
MotoGuardian products and services are intended for individuals aged 18 or older with the legal capacity to enter into a binding contract. By placing an order you confirm you meet these requirements.
MotoGuardian is an integrated motorcycle security and rider safety platform combining GPS tracking hardware, cloud-based services, mobile applications and subscription services. Features include real-time GPS tracking, journey recording, crash detection, emergency contact notifications, theft alerts, geofence alerts, tow-away detection, battery disconnect alerts, maintenance reminders and more.
MotoGuardian is an actively developed platform. The Company may introduce new features, improve existing functionality, or retire obsolete services. Where changes materially affect Customers, reasonable notice will be provided where practicable.
A contract is formed only when your order has been accepted by the Company, payment has been successfully authorised, and we issue an Order Confirmation. The automated acknowledgement sent immediately after placing an order confirms receipt only — it does not constitute acceptance.
All products are offered subject to availability. The Company may refuse or cancel an order where fraudulent activity is suspected, payment fails, incorrect information is provided, or for other legitimate reasons.
All online payments are processed securely using Stripe. MotoGuardian does not store your full payment card details. Prices are shown in the currency specified at checkout. Unless expressly stated, prices exclude delivery charges and applicable taxes.
The Company may amend pricing at any time without prior notice. However, any change will not affect an order already accepted. Subscription price changes apply from the next renewal only.
The Company aims to dispatch all orders promptly. Dispatch and delivery estimates are provided in good faith and are not guaranteed. Risk in the goods passes to the Customer upon delivery. Legal ownership transfers to the Customer after full payment has been received and goods delivered.
Every new MotoGuardian Device includes 12 months of Subscription Services from the date of activation. Following expiry, Customers may renew at the prevailing subscription price. Subscriptions automatically renew unless cancelled before the renewal date.

MotoGuardian must only be used for lawful purposes and in compliance with all applicable legislation. Customers must not use MotoGuardian to monitor individuals without lawful authority, stalk or harass another person, or engage in any fraudulent or unlawful conduct.
The MotoGuardian software is licensed, not sold. The Company grants you a limited, personal, non-exclusive, non-transferable and revocable licence to use the MotoGuardian software solely for its intended purpose. No ownership rights in the software are transferred.
Every MotoGuardian Device includes a 24-month limited hardware warranty. Full details are contained within the Warranty Policy.
If you purchase online as a consumer, you may cancel your order within 14 days of receiving the Device without giving a reason, subject to exclusions. Full details are contained within the Returns & Refund Policy.
Nothing in these Terms excludes or limits the Company's liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
Subject to the above, the Company's total aggregate liability shall not exceed the greater of: (a) the total amount paid by the Customer during the 12 months preceding the event giving rise to the claim; or (b) the minimum amount of liability that cannot lawfully be excluded.
MotoGuardian does not guarantee prevention of theft, recovery of stolen motorcycles, accident prevention, or uninterrupted operation.
The Company processes Personal Data in accordance with GDPR and applicable Irish data protection legislation. Full details are contained within the Privacy Policy.
Nothing in these Terms limits or excludes any statutory rights available to Consumers under the laws of the Republic of Ireland or, where applicable, the United Kingdom. Where mandatory consumer protection legislation provides greater protection than these Terms, that legislation shall prevail.
These Terms are governed by the laws of the Republic of Ireland. The courts of the Republic of Ireland shall have jurisdiction, subject to any mandatory consumer jurisdiction rights under applicable law.
