MOTOGUARDIAN — Important Information & Service Limitations

Please read this information carefully before using the MotoGuardian device and services.

MotoGuardian is designed to help motorcycle owners monitor their vehicle and assist with theft deterrence and recovery through GPS location tracking and alert features. It is intended to provide additional reassurance and visibility, supporting — but not replacing — common-sense security measures and appropriate insurance. We aim to provide a reliable and dependable service, and we take reasonable care in the design and operation of the Device and Services. However, like all connected technology, MotoGuardian is subject to certain practical and technical limitations, which are outlined below.

Nature of the Service

MotoGuardian is not a safety, emergency response, or law-enforcement system. It does not prevent theft and cannot guarantee the recovery of a stolen vehicle. The Service is intended to assist by providing information that may be useful in the event of a theft or unauthorised movement. The Device and Services should not be relied upon as the sole means of protecting your motorcycle.

Network Connectivity

Certain features of the Service rely on mobile network connectivity provided by third-party network operators. • Mobile coverage can vary by location and time and may be affected by buildings, terrain, weather conditions, network congestion, or outages. • Coverage maps provided by mobile network operators are indicative only and may not reflect real-world performance in all situations. • As a result, connectivity may occasionally be interrupted, delayed, or unavailable.

Network Technology Notice (2G Devices)

Some MotoGuardian devices use mobile network technologies, including 2G. In some regions, mobile network operators are reducing or retiring legacy network services. Before purchasing or using a 2G-based device, users should ensure that suitable network coverage remains available in their area. While we endeavour to keep customers informed where possible, network availability is controlled by third-party operators and may change.

GPS Location Services

The Device uses GPS technology to determine location. For best results, GPS requires a clear line of sight to multiple satellites. Location accuracy and speed of location updates may be affected by: • Indoor or underground locations • Tunnels, enclosed spaces, or covered parking • Dense urban environments or heavy foliage • Atmospheric conditions Fix times may vary, and location data may occasionally be delayed or less precise. These limitations are inherent to GPS technology.

Device Power and Battery

The MotoGuardian Device includes an internal backup battery designed to support operation if the primary power supply is interrupted. • Under typical standby conditions, the backup battery may provide extended operation. • Actual battery life will vary depending on usage, signal strength, environmental conditions, and device configuration. Users are responsible for ensuring the Device is correctly installed, powered, and maintained. Alerts or tracking features may be reduced or unavailable if the Device battery is depleted.

Third-Party Hardware

The physical Device is manufactured by a specialist third-party hardware supplier to defined specifications. While we take reasonable steps to ensure compatibility and quality, the Device remains subject to the manufacturer's hardware limitations and warranty terms. Hardware faults or defects will be addressed in accordance with applicable warranty arrangements and consumer law.

Data Accuracy and Availability

The Service transmits and displays data, including location and movement information, using third-party networks and systems. We take reasonable technical and organisational measures to maintain data integrity and security. However: • Data transmission may be delayed or interrupted due to network conditions • Displayed data may not always be current in real time Users should treat information provided by the Service as supportive and indicative, rather than definitive.

Limitation of Liability

Nothing in this disclaimer excludes or limits our liability for: • Death or personal injury caused by our negligence • Fraud or fraudulent misrepresentation • Any other liability that cannot be excluded or limited under applicable law Subject to the above, and taking into account the nature of the Service as a supportive tracking and alerting tool, our liability for foreseeable losses arising directly from the use of the Device or Services is limited to the amount you have paid to us for the Service during the 12 months preceding the event giving rise to the claim. We are not responsible for losses resulting from factors outside our reasonable control, including network failures, GPS limitations, criminal acts of third parties, or failure to maintain the Device.

Your Consumer Rights

This disclaimer is intended to explain the practical limitations of the MotoGuardian system clearly and transparently. It does not override or reduce any rights you have under consumer protection laws, including the Consumer Rights Act 2015.
